Government NOD is required for Appointment of Directors

New and stringent move by Ministry of Home Affairs after the Ministry of Commerce & Industry has restricted the FDI from a country which shares land border with India –

Security Clearance from the Ministry of Home Affairs, Government of India is a pre-requisite before appointment of a director in certain cases-

Where the person seeking appointment as a director in an Indian Company is a national of a country which shares land border with India, he/she shall obtain the necessary security clearance from the Ministry of Home Affairs, Government of India. 

“No application number shall be generated in case of the person applying for Director Identification Number is a national of a country which shares land border with India, unless necessary security clearance from the Ministry of Home Affairs, Government of India has been attached alongwith application for Director Identification Number.”.

Declaration to this effect shall be provided in the consent letter (Form DIR-2) and in the application for DIN (Form DIR-3), and a copy of such clearance shall also be enclosed to these forms.
